Agreement for the Provision of Diving and Boat Excursion Services

Date: March 10, 2025

First Party:

The company Salah Aly’s Housereef Diving & Snorkeling, registered at Werdstrasse 14B, 4623 Neuendorf, Switzerland, hereinafter referred to as "the Company".

Second Party:

Mr./Ms. (Full Name of the Customer), holder of passport/ID number (Passport or ID Number), hereinafter referred to as "the Customer".

Article 1: Subject of the Agreement

1.1. The Company undertakes to provide the diving and leisure activities, as well as boat excursions, booked in advance by the Customer, as specified in the official invoice issued by the Company.

Article 2: Booking and Payment

2.1. A booking is only considered confirmed once the Customer has paid the full amount for the service.

2.2. Payment must be made using one of the payment methods accepted by the Company (bank transfer, Twint, cash. Credit card payments are currently not possible).

2.3. The Customer will receive an official invoice detailing all booked services.

Article 3: Cancellation and Refund Policy

3.1. If the Customer cancels 30 days or more before the scheduled service date, a full refund will be issued.

  • 29 – 20 days before the scheduled service date: 20% of the paid amount will be retained as an administrative fee, and the Customer will receive an 80% refund.

  • 19 – 11 days before the scheduled service date: The Customer will receive a 50% refund.

  • 10 – 0 days before the scheduled service date: No refund will be issued, and 100% of the total amount will be charged.

3.2. The cancellation request must be made in writing via email or official letter. Refunds will be processed within (processing time, e.g., 7–14 days) from the receipt of the cancellation request.

Article 4: Liability Disclaimer

4.1. The Customer confirms that they are in good health and fit to participate in the booked activities and accepts full responsibility for their health condition.

4.2. The Company is not liable for injuries, accidents, or material losses resulting from the Customer’s negligence or failure to follow safety instructions.

4.3. The Customer agrees to follow all instructions given by diving instructors and boat crew.

4.4. The Company is not responsible for delays or cancellations due to force majeure, such as bad weather conditions or government regulations.

Article 5: Dispute Resolution

5.1. Both parties agree to resolve any disputes arising from this agreement amicably.

5.2. If an amicable resolution is not possible, arbitration will be conducted under the applicable laws of Switzerland.

Article 6: Agreement and Signing

6.1. The Customer confirms that their signature and acceptance of the Terms and Conditions in the booking confirmation or electronic booking form (currently not available) constitute a legally binding agreement to all the above terms.

Article 7: Travel Insurance Recommendation

7.1. We strongly recommend obtaining travel health and accident insurance before the trip.
